One of the most pressing and legitimate concerns that our clients have centers around their driver’s license. My clients are individuals who need to be able to drive to make a living and support their families, without their license this becomes difficult.
There are two types of suspensions involved in a DUI charge that are hurdles an experienced DUI Attorney must leap to get you back on the road. The first suspension type is the administrative suspension – if you failed a breath or chemical test your license was suspended for 90 days, if you refused your license was suspended for 1 year. This is the suspension that the police officer told you (or should) about.
The second type of license suspension is imposed by the court. If you are convicted you will, on a first offense, lose your license to drive for a minimum of six months for up to 3 full years. This is the suspension that the officer did not want you to know about – because if you knew about it you probably would not have taken the breath test.
We can help with both of these suspensions. The first suspension we attack is the administrative suspension – we want you driving as soon as possible. There are two ways to attack it with one resulting in the immediate right to drive, and the other with you being able to drive after waiting periods of either 15 or 30 days depending on whether or not you refused to take the breath test.
The second type of suspension is attacked while we attack the DUI charges – if we prevail on your case there is no suspension to worry about!
